Umicore disputes the decision of the French Competition Authority and will appeal

Umicore has taken note of the decision of the French Competition Authority regarding the company’s sales of zinc cladding materials and rainwater systems and of the fine imposed, which amounts to EUR 69,243,000. Umicore will appeal this decision in court.

The French Competition Authority claims that Umicore Building Products France had imposed an exclusive purchase obligation on some of its French distributors between 1999 and 2007 and in doing so had abused an alleged position of market dominance. Umicore categorically denies having imposed or having sought to impose any such exclusive purchase obligations and has provided numerous elements that support its position. A close examination of the facts of the case shows among other things that the distributors named in the statement of objections had a broad and varied range of supply sources to tap into, a significant portion of which was from competitors of Umicore Building Products France.

Moreover, the elements cited by the Authority to establish that Umicore Building Products France held a dominant position in no way reflect the realities of the cladding materials market. In this market, zinc faces a constant battle against a broadrange of substitutable products. The position of the Authority is all the more unfounded as it is in contradiction with that of the European Commission and the German Competition Authority which, on repeated occasions in previous decisions, ruled that zinc products are just a sub-segment of the cladding materials market and should not be considered in isolation. According to these previous decisions, Umicore Building Products France does not have a dominant position in any way.

Un recours en justice sera introduit contre cette décision.

L’Autorité de la Concurrence française reproche à Umicore Building Products France d’avoir imposé une exclusivité d’approvisionnement à certains distributeurs français entre 1999 et 2007 et d’avoir, de la sorte, abusé d’une prétendue position dominante. Umicore conteste catégoriquement avoir imposé ou cherché à imposer une quelconque exclusivité d’approvisionnement et dispose de nombreux éléments étayant sa position. L’étude approfondie du dossier démontre, notamment, que les distributeurs repris dans la notification de griefs disposaient d’un approvisionnement large et varié dont une part importante était issue de concurrents d’Umicore Building Products France.

Par ailleurs, les éléments sur lesquels l’Autorité s’appuie pour établir qu’Umicore Building Products France aurait ou aurait eu une position dominante ne reflètent en rien la réalité du marché des matériaux de couverture, dans lequel le zinc se bat chaque jour pour trouver sa place parmi une multitude de produits substituables. La position de l’Autorité française est d’autant plus infondée qu’elle est en contradiction avec celle de la Commission Européenne et de l’Autorité de la concurrence allemande qui ont, à plusieurs reprises dans des décisions antérieures, estimé que les produits en zinc ne constituent qu’un sous-segment du marché des matériaux de couverture et ne doivent pas être considérés de façon isolée. Selon ces décisions antérieures, Umicore Building Products France ne dispose en aucun cas d’une position dominante.

Umicore heeft kennis genomen van de beslissing van de Franse Mededingingsautoriteit met betrekking tot de verkoopactiviteiten van zink materialen voor dakbedekking en regenwatersystemen en de boete van 69.243.000 euro. Er zal beroep worden aangetekend tegen deze beslissing voor de gerechtelijke instanties.

De Franse Mededingingsautoriteit beschuldigt Umicore Building Products France een bevoorradingsexclusiviteit opgelegd te hebben aan bepaalde Franse distributeurs tussen 1999 en 2007 en zo misbruik gemaakt te hebben van een vermeende dominante marktpositie. Umicore betwist uitdrukkelijk dat zij enige bevoorradingsexclusiviteit heeft opgelegd of zou getracht hebben op te leggen en zij beschikt over talrijke elementen die dit standpunt ondersteunen. Een grondige lezing van het dossier toont aan dat de in de punten van bezwaar genoemde distributeurs over een ruime en gevarieerde bevoorrading beschikten waarvan een aanzienlijk deel afkomstig was van concurrenten van Umicore Building Products France.

Daarenboven weerspiegelen de elementen waar de Mededingingsautoriteit zich op baseert om te bepalen dat Umicore Building Products France een dominante marktpositie had of zou gehad hebben geenszins de realiteit van de markt voor materialen voor dakbedekking; een markt waarin zink dagelijks haar positie moet verdedigen ten opzichte van een groot aantal, volledig vervangbare producten. Het standpunt van de Franse Mededingingsautoriteit is des te meer ongegrond, aangezien het volledig in strijd is met het standpunt van de Europese Commissie en de Duitse Mededingingsautoriteit die in eerdere besluiten herhaaldelijk bepaalden dat zinkproducten één van de subsegmenten uitmaken binnen de markt van materialen voor dakbedekking en niet op geïsoleerde wijze kunnen beschouwd worden. Overeenkomstig deze eerdere besluiten, beschikt Umicore Building Products France op geen enkele manier over een dominante positie.
