Umicore to appeal decision regarding its imports of certain rechargeable battery materials into the United States

The U.S. International Trade Commission (ITC) today issued notice of its decision relating to the patent infringement complaint brought against Umicore by BASF and University of Chicago Argonne National Laboratory. Umicore strongly disputes the findings of infringement of two U.S. patents relating to certain battery cathode materials. The decision to issue a limited exclusion order is subject to automatic review by the United States Trade Representative. If the decision is upheld, Umicore intends to appeal to the United States Court of Appeals for the Federal Circuit.

Kurt Vandeputte, Vice President of Umicore’s Rechargeable Battery Materials business unit, said: “We believe that the ITC’s decision is wrong on the science and the law. We intend to appeal the decision in the interest of Umicore, its customers and U.S. battery innovation and research.”

La US International Trade Commission (ITC) a publié aujourd’hui un résumé de sa décision concernant la plainte pour violation de brevets contre Umicore par BASF et University of Chicago Argonne National Laboratory. Umicore conteste fermement les conclusions de violation de deux brevets américains portant sur certains matériaux cathodique pour batteries. La décision d’émettre un ordre d’exclusion limitée est automatiquement soumise à la révision par le United States Trade Representative. Si la décision est maintenue, Umicore a l’intention d’aller en appel auprès de la United States Court of Appeals for the Federal Circuit.

Kurt Vandeputte, Vice President de la business unit Rechargeable Battery Materials d’Umicore a déclaré : « Nous pensons que la décision de l’ITC est erronée du point de vue scientifique et légal. Nous avons donc l’intention d’aller en appel contre cette décision dans l’intérêt d’Umicore, de ses clients et de la recherche et l’innovation dans le domaine des batteries aux Etats-Unis. »

De Amerikaanse International Trade Commission (ITC) heeft vandaag een kennisgeving gedaan over haar uitspraak in de procedure voor inbreuk op octrooien die ingediend werd door BASF en de University of Chicago Argonne National Laboratory tegen Umicore. Umicore betwist nadrukkelijk de vaststelling dat twee Amerikaanse octrooien die betrekking hebben op bepaalde kathodematerialen voor batterijen, geschonden werden. Het uitspreken van een verwijderingsbesluit is onderhevig aan een automatische herziening door de Amerikaanse Trade Representative. Indien de uitspraak wordt gehandhaafd, zal Umicore beroep aantekenen voor het Amerikaanse Federal Circuit Court of Appeals.

In het belang van Umicore, onze klanten en het onderzoek en ontwikkeling inzake batterijen in de Verenigde Staten zullen we beroep aantekenen tegen deze beslissing.”
